2. What data I process and why
Request form
When you ask for a proposal or a demo, I collect your name, your email address, the name of your business, the plan you are interested in, whether you want the domain add-on, your phone number if you choose to give it, the name of the person who referred you if you provide it, and any description you want to add about your project. Along with the request, I store the language and the address of the page you send it from and, if you arrive from a search engine, a social network, an ad or a link with campaign parameters, that source, so I can tell which channels work. I use this data to reply to you, prepare the demo and the proposal and, if you decide to go ahead, manage the project. The form cannot be sent unless you tick the box accepting this policy.
Phone and WhatsApp
If you call me or message me on WhatsApp, I process your number and any data you give me in the conversation for the same purpose. WhatsApp is a service of Meta Platforms Ireland Limited, with its own terms and privacy policy, which I recommend you read.
Contracts and payments
If you hire me, I process the data needed to draw up the proposal, provide the service, issue invoices and meet my tax obligations. I take payments through Stripe: you enter your payment details on Stripe's pages and I do not store card numbers. From Stripe I receive the payment confirmation and the necessary billing details.
Referral programme
If you refer a business to me, I process your name and your contact details to record the referral and, where applicable, the data needed to pay your commission by bank transfer and to meet the tax obligations relating to that payment.
Browsing
The site does not use analytics cookies or advertising pixels. To know which pages are visited and which channels work, the server keeps aggregate counts, by day, page and language, of visits and of clicks on WhatsApp, phone and email, together with the source of the visit: the search engine, social network or campaign it came from. These counts do not include your IP address or any identifier, and they cannot be used to tell who you are. Your IP address is processed only for technical purposes, to serve the pages and limit abuse, and is not stored with your request. You can find the details in the cookie policy.
3. Legal basis
- Your consent, which you give when you send the form or write to me, and which you can withdraw at any time.
- Taking pre-contractual steps at your request (preparing the demo and the proposal) and performing the contract if you accept it.
- Compliance with legal obligations, in particular tax and accounting obligations, where there is invoicing.
- My legitimate interest in keeping the site secure and preventing abusive use.
- My legitimate interest in knowing, in aggregate and without identifying you, which pages and channels work best.
4. Recipients and processors
I do not disclose your data to third parties unless required by law. To provide the service, I use providers that access the data as processors:
- Hosting of the site and of the request database: Avoro, in a data centre in Germany, within the European Union.
- Payments and subscriptions: Stripe Payments Europe, Ltd. (Ireland) and Stripe, Inc. (United States), with the safeguards laid down in European law for international transfers.
- Messaging, if you choose to message me on WhatsApp: Meta Platforms Ireland Limited.
- Internal notifications: when a request comes in, I receive an automatic notification in a private Discord channel (Discord Inc., United States) with the business name and the chosen plan, without your name, email address or phone number.
5. How long I keep the data
Requests are kept while I deal with your enquiry and, if we do not end up entering into a contract, for a reasonable time so that we can pick up the conversation again if you write to me again. If you hire me, I keep the data for the duration of our relationship and, afterwards, for the periods required by tax and legal liability obligations. Archiving a request does not delete it; data is deleted when it is no longer needed, or when you ask for deletion and there is no legal obligation to keep it.
6. Your rights
You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw your consent, by writing to me at darkopastors@gmail.com or on WhatsApp at +34 660 102 030, stating which right you wish to exercise. I may ask you to prove your identity. If you believe I have not handled your request properly, you can lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD) at www.aepd.es.
7. Security
Requests are stored in a private database, outside the site's public folder, protected by a password and accessible only to the owner over an encrypted connection. I apply reasonable technical and organisational measures to prevent unauthorised access, loss or alteration. Please do not include in the form any data that is not necessary for your request.
8. Changes to this policy
I may update this policy to reflect changes in the law or in the service. I will publish the current version at this same address, with the date it was last updated.
